  19. The Copyright Royalty Tribunal was established by act of October 19, 
  20. 1976 (17 U.S.C. 801).  The Tribunal is composed of five Commissioners 
  21. appointed by the President with the advice and consent of the Senate.

  23. The Tribunal adjusts copyright royalty rates for cable retransmission of 
  24. broadcast signals in recording new versions of previously recorded songs
  25. and for noncommercial educational stations that broadcast musical, pictorial,
  26. graphic, and sculptural works.

  28. The Tribunal also has stand-by authority to adjust the rates for jukeboxes 
  29. and satellite retransmission of broadcast signals to satellite homedish
  30. owners if the parties are unable to reach voluntary agreements among
  31. themselves.  In addition, the Tribunal distributes the royalty fees
  32. deposited with the Copyright Office by cable operators and satellite
  33. carriers to the proper copyright owners.

  35. In making its distribution determinations, the Tribunal considers the 
  36. harm incurred by the copyright owners, the benefit to the cable satellite
  37. user, the marketplace value of the work, the time the work was aired, and
  38. the quality of the broadcast.
